CAGC Foundation Build Your Career Raffle Official Rules and Regulations:  CAGC Foundation, Inc., a tax exempt organization under Section 501©(3) of the Internal Revenue Code, is conducting a raffle pursuant to North Carolina General Statutes § 14-309.15, Raffles. The Rules and Regulations of the raffle are set forth below.

By purchasing a raffle ticket, a purchaser recipient agrees to be bound by these rules and regulations:

Airfare: (*There is no airfare included in this raffle prize); Any airfare included in the raffle prize trip package is TBD; tickets included are for Coach/ Economy seating to desired airline of choice; airline used if flying out of Charlotte, NC will most likely be American Airlines; tickets may be upgraded for an additional cost to winner and any associated fees or upgrade cost is not the responsibility or at an additional cost to CAGC, it’s Foundation or BYC; raffle winner is advised to contact the airline directly to obtain necessary information for scheduling, any ticket purchase blackout dates, luggage fees and/or any additional applicable fees, taxes, etc.)

Additional Airfare Info: (*There is no airfare included in this raffle prize); If the raffle prize includes a trip and/or airfare, the winner may purchase additional airline tickets at their own expense for an additional fee, determined by providing airline; CAGC, its Foundation or BYC is not responsible for this additional cost and does not assume any liability or responsibility for any additional fees, lost or stolen luggage, canceled or delayed flights, airline or hotel cancellation fees, inclement weather or any illness/injury to any individual utilizing any portion of this trip/airline package.

Accommodations: The winner of this raffle prize is TBD.

The Internal Revenue Service (IRS) has taken the position that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts, and consequently do not qualify as deductible charity contributions.

The Prize winner shall assume all fees, local, state, and federal taxes. Such fees may include, but are not limited to: income taxes based on the value of the trip. The CAGC Foundation, Inc. takes no responsibility for any tax liabilities or costs. Consult your tax advisor. This offer is void where prohibited by law, and all federal, state, and local laws and regulations apply.

BY ENTERING THIS RAFFLE, ENTRANTS ACCEPT AND AGREE (1) TO BE BOUND BY ALL OF THE RULES, LIMITATIONS AND RESTRICTIONS SET FORTH HEREIN AND (2) THAT THEIR NAMES AND/OR LIKENESSES MAY BE DISCLOSED TO AND USED BY THE NEWS MEDIA AND MAY OTHERWISE BE USED BY CAGC FOUNDATION, INC. FOR PUBLICITY PURPOSES AND IN LISTS, ARTICLES, AND/OR PICTURES OF PRIZE WINNERS TO BE PUBLISHED IN PRINT MEDIA, ONLINE, AND ANNOUNCED ON THE CAGC FOUNDATION, INC WEBSITE. CAGC FOUNDATION, INC.’S INTERPRETATION AND APPLICATION OF THE RULES AND REGULATIONS SHALL BE FINAL.

BY ENTERING THIS RAFFLE, EACH PARTICIPANT RELEASES CAGC FOUNDATION, INC, ITS DIRECTORS, OFFICERS, REPRESENTATIVES AND AGENTS FROM ANY AND ALL LIABILITY FOR INJURIES OR DAMAGES OF ANY KIND CAUSED BY PARTICIPATING IN THE RAFFLE OR WINNING ANY PRIZE OR RESULTING FROM ACCEPTANCE, POSSESSION, USE, OR MISUSE OF ANY PRIZE, AND EACH WINNER AGREES TO INDEMNIFY AND HOLD CAGC FOUNDATION, INC HARMLESS FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS, AND ACTIONS OF ANY KIND RISING IN CONNECTION WITH OR AS A RESULT OF PARTICIPATING IN THE RAFFLE OR THE WINNER’S ACCEPTANCE OR USE OF ANY PRIZE.

Purchase of Tickets: Each ticket is TBD. All amounts paid must be in US dollars. There will be no limit on the maximum number of tickets sold. Only natural persons may enter. No entity may purchase a ticket. If the name of more than one person is submitted with a ticket and that ticket is selected as a winning ticket, then the person named first will be deemed the holder of record of that ticket and declared the winner. Division of prize by a group obtaining a ticket in common shall be the sole responsibility of the person named as the holder of record of that ticket should that ticket be selected as a winner. The cost to purchase a raffle ticket is not tax deductible.

CAGC Foundation, Inc. reserves the right to reject any entry form that is submitted with payment that does not constitute “good funds.” All defective or physically altered entry forms will be immediately disqualified as determined by CAGC Foundation, Inc. All orders for tickets must be received by the indicated deadline. CAGC Foundation, Inc. assumes no responsibility for lost, late, misdirected or non-delivered mail, or any other failure to receive orders or deliver receipts prior to the drawing deadline. The deadline for receiving raffle ticket orders is TBD.

A RAFFLE PARTICIPANT’S SOLE AND EXCLUSIVE REMEDY FOR CAGC FOUNDATION, INC. BREACH OR OTHER CLAIM AGAINST CAGC FOUNDATION, INC. RELATED TO THE PRIZE OR THIS RAFFLE SHALL BE LIMITED TO THE RETURN OF THE DONATION FOR HIS OR HER RAFFLE TICKETS. IN NO EVENT SHALL CAGC FOUNDATION, INC., ITS DIRECTORS, OFFICERS, AGENTS OR REPRESENTATIVES BE LIABLE TO ANY PARTY FOR ANY LOSS OR INJURIES TO EARNINGS, PROFITS OR GOODWILL, OR FOR ANY INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY PERSON OR ENTITY WHETHER ARISING IN CONTRACT, TORT OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BY PARTICIPATING IN THE RAFFLE PRIZE CONTEST, EACH PARTICIPANT AND WINNER WAIVES ANY AND ALL CLAIMS OF LIABILITY AGAINST CAGC, IT’S FOUNDATION , BYC, ITS EMPLOYEES AND AGENTS, THE RAFFLE PRIZE SPONSOR(S) AND THEIR RESPECTIVE EMPLOYEES AND AGENTS, FOR ANY PERSONAL INJURY OR LOSS WHICH MAY OCCUR FROM THE CONDUCT OF, OR PARTICIPATION IN, THE RAFFLE PRIZE, OR FROM THE USE OF ANY PORTION OF THE RAFFLE PRIZE.

How to Obtain a Ticket: An individual can purchase as many raffle tickets as he or she may wish, subject to availability. To obtain a raffle ticket, use one of the following methods:

  1. Go to new web link provided for next upcoming raffle, prize/date TBDuse the order form therein and submit your order in accordance with the instructions provided.
  2. Use the order form found on the BYC website and mail it along with your check to CAGC FOUNDATION, INC. at 4824 Parkway Plaza Blvd., Suite 115, Charlotte, NC 28217. If you prefer to use a credit card, you must include the information required to be submitted when using your credit card to purchase a ticket (*This purchase option is not available for this raffle).
  3. Tickets ordered via email via the instructions on the CAGC FOUNDATION, INC. website must include the following: the type of credit card you are using, your name, address, telephone number, email address, your credit card number, the credit card security code, and expiration date (*This purchase option is not available for this raffle).
  4. Tickets may be purchased directly from or ordered through any approved CAGC FOUNDATION, INC. vendors and locations. All entries must include payment by cash, check or credit card and must include the requested entry information on the applicable order form (*This purchase option is not available for this raffle).
  5. All checks should be made payable to “CAGC FOUNDATION, INC.” (*This purchase option is not available for this raffle).
  6. All raffle ticket purchasers will be required to submit their name, email address, and phone number.

No refunds will be made except under the following conditions: (a) The ticket order with payment is received after XXX tickets have been purchased (*N/A for this raffle because there is no cap on total number of tickets sold) or (b) the ticket order is received after raffle contest ends TBD. No other refunds are available except at the exclusive discretion of CAGC FOUNDATION, INC. and the CAGC FOUNDATION, INC. assumes no responsibility for lost, late, misdirected or non-delivered mail or email or any other failure to receive orders or deliver receipts prior to the drawing deadline.

Selection of Winner: The BYC Raffle drawing will be conducted on TBD and the winner will be chosen by random computer-generated selection. The winning ticket will be announced TBD. Winner is not required to be present to win prize.  If Winner is not present during drawing, Winner will be notified via a direct phone call from the BYC Director on (date TBD), as well as via email and/or a direct notification letter delivered via certified registered mail.

The raffle prize awarded to the winner is not transferable, redeemable for cash or exchangeable for any other prize. Any prize item or trip, including hotel accommodations and airfare (not included with this raffle prize), must be claimed and/or redeemed within three (3) years of the date of prize awarded. Hotel and airline companies have additional stipulations that are date-specific and the winner must book travel during the dates specified by each (winner is advised to contact both the hotel and airline [no airfare included in this raffle prize] to obtain full details of booking requirements and/or stipulations/additional taxes and/or fees).

Should the prize winner not claim the prize within 60 days of the prize drawing date, the prize will be forfeited, and another winner may be randomly selected by CAGC FOUNDATION, INC from the remaining tickets. In addition to the winner’s name being posted on the CAGC FOUNDATION, INC website, the name of the winner of the prize may be obtained by sending a self-addressed stamped envelope to CAGC FOUNDATION, INC at 4824 Parkway Plaza Blvd., Suite 115, Charlotte, NC 28217 within one week of the drawing.

In order to collect his or her prize, a raffle ticket winner may be required to sign and deliver to CAGC FOUNDATION, INC: (a) a sworn affidavit of eligibility in accordance with these Rules and applicable law, including without limitation that he or she is at least 18 years old at the time he or she entered to win the winning raffle ticket; (b) such written information as is required by any applicable tax and/or real estate laws, including without limitation his or her Social Security Number; proof of identity in forms satisfactory to CAGC FOUNDATION, INC showing that the person claiming the prize is the same person who is named on the winning raffle ticket; and (d) the winning raffle ticket stub. Winners will be required to submit a W-4, W-2G, Form 5754 or similar tax form for tax withholding purposes.

Winning Odds: The odds of winning a prize will depend on the number of raffle tickets distributed. As an example, if 2,500 tickets are distributed, the odds of winning the Grand Prize is 1 in 2,500. If fewer tickets are distributed, the chance of winning the Grand Prize improves.

Eligibility: Anyone 18 years of age or older at the time of obtaining his or her raffle ticket may enter. Members of the CAGC FOUNDATION, INC. and Carolinas AGC, Inc. Board of Directors and Trustees, authorized agents and employees thereof, consultants, attorneys, independent accountant firm members and the immediate families of the aforementioned (or significant others living in the same household) are excluded from participating in the raffle and are not eligible to win a prize. The raffle is void where prohibited or restricted by law. An affidavit of eligibility may be required from the prize winner.

The winner of this raffle will be announced accordingly. If fewer than 50 tickets are distributed by (TBD). CAGC FOUNDATION, INC reserves the right to cancel the raffle.

General Terms and Conditions:

ANY VALUATION OF THE PRIZE(S) STATED ABOVE IS BASED ON AVAILABLE INFORMATION PROVIDED TO THE CAGC FOUNDATION, AND THE VALUE OF ANY PRIZE AWARDED TO A WINNER GREATER THAN $600 IN VALUE WILL BE REPORTED FOR TAX PURPOSES AS REQUIRED BY LAW. RAFFLE PRIZE WINNER IS SOLELY RESPONSIBLE FOR REPORTING AND PAYING ANY AND ALL APPLICABLE TAXES RELATED TO THE PRIZE(S) AND PAYING ANY EXPENSES ASSOCIATED WITH ANY PRIZE WHICH ARE NOT SPECIFICALLY PROVIDED FOR IN THE OFFICIAL RULES. THE CAGC FOUNDATION WILL COMPLY WITH ALL APPLICABLE TAX REQUIREMENTS, INCLUDING REPORTING AND WITHHOLDING REQUIREMENTS. THE WINNER OF THIS RAFFLE PRIZE IS RESPONSIBLE FOR ALL TAXES OWED ON WINNINGS. THE FOUNDATION WILL MAIL APPLICABLE TAX FORMS TO THE WINNER OF THE RAFFLE AND THE VALUE OF THE PRIZE WILL BE REPORTED TO THE IRS. THE PURCHASE COST OF RAFFLE TICKET(S) DOES NOT QUALIFY FOR CHARITABLE CONTRIBUTION TAX DEDUCTIONS FOR FEDERAL OR STATE INCOME TAX REPORTING. THE RAFFLE PRIZE WINNER WILL NEED TO SIGN A W-4 IRS TAX WITHHOLDING FORM AND WILL ALSO BE SENT A W-2G FORM BY THE CAGC FOUNDATION BY JANUARY 31, 2020 TO REPORT GAMBLING/GAMING WINNINGS AND IT IS THE RESPONSIBILITY OF THE RAFFLE PRIZE WINNER TO FILE THESE FORMS ACCORDINGLY WITH THE IRS TO COMPLY WITH FEDERAL AND STATE LAWS. PLEASE VISIT THE IRS WEBSITE FOR MORE INFORMATION.

THE CONDUCT OF THIS RAFFLE IS GOVERNED BY THE APPLICABLE STATE AND FEDERAL LAWS OF THE UNITED STATES OF AMERICA, WHICH TAKE PRECEDENCE OVER ANY RULE TO THE CONTRARY HEREIN, AS REQUIRED BY LAW. THE CAGC FOUNDATION, BYC AND ITS STAFF, WILL COMPLY WITH ALL APPLICABLE LAWS AND TAX REQUIREMENTS AS MANDATED BY LOCAL, STATE AND FEDERAL LAW.

ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THIS CONTRACT, OR THE BREACH THEREOF, SHALL BE SETTLED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (PURSUANT TO ITS EXPEDITED PROCEDURES) UNDER ITS COMMERCIAL ARBITRATION RULES, AND JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN THE SUPERIOR COURT FOR THE COUNTY OF MECKLENBURG, NORTH CAROLINA, WHICH SHALL HAVE EXCLUSIVE JURISDICTION THEREOF.
